Before you keep a New York trout, check the water — not just the fish
One stream may allow five trout, the next reach may allow three, one or zero, and a nearby Great Lakes tributary can use completely different hook, night-fishing and possession rules. This guide shows the exact checks that prevent common violations and explains New York’s fine framework without inventing a fixed ticket amount.

There is no universal “New York trout fine”
New York’s Fish & Wildlife Law separates the underlying offense from additional civil-penalty exposure. The exact amount in a real case depends on the charge, fish involved, other applicable provisions and the disposition of the case.

Up to $250A Fish & Wildlife Law offense that is not classified as a misdemeanor or given another specific penalty is generally punishable by:
- up to a $250 fine,
- up to 15 days imprisonment,
- or both.

- $200, plus
- $100 for each fish or fish part involved.
Different mistakes can create different charges
The issue is possession above the legal number or applicable sublimit.
Fishing for a species can itself be prohibited even if every fish would be released.
A trout may be released yet the fishing method can still violate the applicable rule.
Fishing without the required freshwater privilege is a separate issue from whether the fish itself was legal.

Foul-hooked trout must be released — and freshwater gaffs are generally prohibited
Trout and listed salmonids hooked somewhere other than the mouth must be released without unnecessary injury.
Use or possession of gaffs/gaff hooks while freshwater fishing is prohibited except for the listed ice-fishing/bowfishing exceptions.
Great Lakes waters also expressly prohibit snatching and attempted snatching.
Do not apply inland-trout-stream rules to Lake Erie or Lake Ontario tributaries

Lake Erie tributary seasonal gear trap
Certain Lake Erie tributary reaches prohibit fishing at night: fishing hours are ½ hour before sunrise to ½ hour after sunset.
Applies on the designated seasonal tributary reaches.
Hooks attached to lures must be free-swinging except on artificial flies or jigs under the listed rule.
A Finger Lakes tributary can restrict your line, hook and landing net
Covered tributaries generally restrict anglers to one line.
Subject to listed exceptions.
Possession of a larger hook gap is prohibited on covered tributaries.
Maximum 50″ around frame and 20″ handle unless an exception applies.
Night fishing
Covered Finger Lakes tributaries generally prohibit angling between sunset and sunrise Apr. 1–May 15 and Oct. 1–Dec. 31, subject to listed exceptions.
Winter closure
Angling is generally prohibited Jan. 1–Mar. 31 on covered tributaries except specifically listed reaches such as the applicable Fall Creek section.
Delaware River trout: the New York/Pennsylvania border rule is only one fish
Delaware River and West Branch Delaware River border-water rule.
Artificial lures only.
New York and Pennsylvania licenses are reciprocally recognized on the covered boundary portion — not automatically on every tributary.
“I released it” does not automatically make the fishing legal
Catch-and-release fishing must itself be authorized for the species/water.
Artificial-lure-only water does not allow worms, fish eggs or other natural bait.
Do not put a C&R fish into a bucket, tub, livewell, stringer or similar holding device.
Measuring, weighing and photos are allowed only if handling does not cause harm or keep the fish out too long.
During a true closed season, intentionally fishing for the species is prohibited — even if your plan is to release every fish.

Do not collect aquatic insects from trout water or its bank
New York prohibits taking an aquatic insect — including an insect that lives in water during any life stage — from waters inhabited by trout or from the banks of those waters.
Wild bait caught here generally stays here
Only legal species and legal collection methods may be used.
Personally harvested fish intended as bait may generally only be used in the waterbody from which they were collected.
Motorized overland transport is restricted except within designated transportation corridors.
The receipt must identify seller, sale date, baitfish species and quantity.
Baitfish with no receipt or a receipt older than 10 days are treated as uncertified bait.
Trout eggs have a one-quart possession ceiling — and chumming is prohibited
Combined eggs from trout, lake trout and Atlantic salmon while on state waters or shores.
Fish may not be taken or attempted to be taken by chumming with fish eggs.
Properly labeled eggs from a DEC-permitted hatchery may be used where bait is otherwise legal.
Your vehicle is part of the possession calculation
Fish in a vehicle used to access the water count toward number and size limits in possession.
If allowed by that water/season and each additional fish is immediately released uninjured.
A person may not intentionally kill or injure fish outside the legal size/possession rule.
Trout fishing usually requires a freshwater license at age 16+

New York trout violation, rule & fine questions
What is the fine for an illegal trout in New York?
There is no single universal trout-ticket amount. A Fish & Wildlife Law offense that is not classified as a misdemeanor or assigned another specific penalty is generally punishable under ECL §71-0923 by up to a $250 fine, up to 15 days imprisonment, or both. ECL §§71-0919 and 71-0925 also establish additional civil-penalty exposure, generally $200 plus $100 per fish unless another specific penalty controls. The actual case outcome depends on the exact charge and facts.
How many trout can I keep from a New York inland trout stream?
The statewide starting rule from April 1 through October 15 is five trout with only two longer than 12 inches, but Stocked-Extended and Wild Quality reaches allow three, Wild-Premier allows one, and Catch-and-Release reaches allow no harvest.
Is Beaver Kill open for trout fishing on August 15, 2026?
Beaver Kill contains several different regulated reaches. DEC currently lists the section from Iron Bridge at Horton downstream to the first Route 17 overpass as closed to angling from July 1 through August 31 to protect thermally stressed trout. Other Beaver Kill reaches have separate management categories, so verify the exact location.
Can I keep trout after October 15 in New York?
Standard inland trout streams change to catch-and-release only with artificial lures from October 16 through March 31. Lakes, Great Lakes, Finger Lakes, border waters and special waters can use different rules.
Can I fish for trout during a closed season if I release the fish?
No. DEC states that a person may not fish for a species, including catch-and-release fishing, during a true closed season on that water. This is different from an expressly authorized catch-and-release season.
Can I put a catch-and-release trout in a livewell for a photo later?
No. DEC’s catch-and-release regulation says fish may not be placed in a bucket, tub, livewell, on a string or in another holding device. Measuring, weighing and photographing must be done without extended air exposure or harmful handling.
What if a trout is foul-hooked?
New York requires foul-hooked trout, lake trout and listed salmon species to be released without unnecessary injury.
How many fishing lines can I use in New York freshwater?
The general statewide angling rule allows no more than three lines, with no more than five lures or baits and no more than 15 total hook points on each line. Special waters can impose stricter rules.
Can I use three lines on Finger Lakes tributaries?
Not on covered Finger Lakes tributaries where the special regulation limits anglers to one line with a single hook point, subject to listed exceptions. Those tributaries also have hook-gap, landing-net and seasonal night-fishing restrictions.
Can I move live baitfish from one New York trout water to another?
Personally harvested baitfish intended for bait generally may only be used in the same waterbody from which they were collected. Motorized overland transport is restricted except within designated corridors. Certified dealer bait has different transport rules but requires valid receipt documentation.
How long is a certified baitfish receipt valid in New York?
DEC states that baitfish without a receipt or with a receipt older than 10 days are considered uncertified bait.
Do trout in my car count toward my possession limit?
Yes. Fish in a vehicle used to access the water count toward the number and sizes of fish in possession.
Do I need a fishing license for trout in New York?
Most anglers age 16 and older need a New York freshwater fishing license unless a specific exemption applies. Anglers can show licensure through HuntFishNY, a plain-paper copy, or by providing their 12-digit DEC ID to an officer as allowed by DEC.
