Delaware fishing rules change from stocked ponds to the open Atlantic
Use this guide to separate freshwater, trout, tidal-river, Delaware Bay and Atlantic Ocean rules — then check species-specific size limits, seasonal windows and the three-mile state-water boundary before keeping your catch.
Delaware has four very different fishing-rule environments
Freshwater ponds & streams
Largemouth bass, smallmouth bass, crappie, pickerel, sunfish and other inland species.
Designated trout waters
Separate season-opening, trout-stamp, time-of-day and restricted fly-fishing provisions.
Delaware River, Bay & tidal waters
Striped bass, white perch, weakfish and other tidal species can carry season- or location-specific rules.
Atlantic Ocean
State rules generally control to three nautical miles; federal regulations can differ farther offshore.

Five checks before your fish becomes possession
Black sea bass and striped bass do not share rules simply because both contain “bass” in the name.
Freshwater, trout water, Delaware Bay, tidal river or ocean?
Tautog, trout and other species have specific open periods.
Some fish use a minimum while striped bass uses a legal window.
Stop once the daily possession limit for the species is reached.

Smallmouth bass greater than 12 inches but less than 17 inches must be immediately released.
Delaware trout fishing has a season opener, stamp and time-of-day rule
Applies to designated stocked trout ponds such as Tidbury and Newton.
Designated New Castle County trout streams open on the traditional spring stream date.
All trout species combined; restricted fly-only waters use a four-fish possession limit.

DNREC changed several dates from the tentative 2026 Fishing Guide because of a change involving the trout supplier. DNREC says only rainbow trout will be stocked in 2026.

“Fly fishing only” means more than choosing a fly-shaped lure
A fly rod must be used.
Artificial flies must use one single pointed hook.
No more than two flies may be on the line at one time.
Spinners, spoons, plugs, conventional lures and natural bait are prohibited in restricted trout sections.
A legal fishing season does not guarantee every wildlife-area pond is open
Wildlife-area ponds
Licensed fishing in Division-managed wildlife-area ponds is generally prohibited during this period unless an area-specific current map provides an exception.
Additional closure
Fishing at covered wildlife-area ponds is also generally prohibited during spring turkey season unless current area-specific rules provide otherwise.

Delaware rules can change again three miles offshore
Delaware state waters generally extend from the coast to three nautical miles. Beyond that, federal rules can control species such as striped bass and black sea bass.

DNREC explains that a boat may launch in Delaware and travel to another state’s waters to fish under that state’s legal license without obtaining a Delaware boat fishing license solely for transit.

- Check the species season: especially trout, tautog, striped bass and black sea bass.
- Save today’s minimum or slot: flounder uses a different minimum after June 1.
- Check the daily limit: bluefish differs by private/shore versus for-hire fishing.
- Confirm state versus federal waters: crossing three nautical miles can change the applicable rule.
- Check wildlife-area access: a statewide fish season does not guarantee a managed pond is open.
- Bring your license and trout stamp when applicable.
- Measure before placing a fish in the cooler.

Delaware reduced the state-water minimum size from 13 to 12.5 inches, moved the opening date to May 1 and removed the former October in-season closure. The daily limit remains 15 fish.

Tautog must be at least 16 inches total length. The daily limit is four per person. The fishery is open January 1 through May 15 and July 1 through December 31.
What is Delaware’s bluefish limit?
The current daily limit is five bluefish per angler from shore or a private boat and seven per angler on qualifying for-hire vessels. Delaware lists no minimum size.
Can I keep striped bass in federal waters off Delaware?
No recreational striped bass harvest is permitted in federal waters from three to 200 miles offshore. Delaware state-water rules apply shoreward of the three-mile boundary, subject to spawning-ground restrictions and current size windows.
